Terms of service

These terms of service are an agreement between you and UpskyAI. If you use the site on behalf of a company, you represent that you have authority to bind it.

If we sign a specific contract, proposal, or statement of work, that document controls if it conflicts with these terms.

UpskyAI is a software and artificial intelligence lab. Through this site and our services we may offer:

• Information about our company, products, research, and ways to contact us.
• Software products and systems, including systems powered by artificial intelligence.
• Design, engineering, and consulting work for companies, subject to a specific agreement.

Some products or engagements may have additional terms, service levels, or exhibits. Access to features that are in development or experimental may change or be withdrawn.

When a product or service uses artificial intelligence models or agents, the following applies:

• Outputs may be incomplete, inaccurate, or unsuitable for your case. You should review them before using them in a real context.
• Do not submit information you are not entitled to share, or data that should stay outside systems of this kind.
• To operate the service we may rely on vendors that process your inputs as processors, solely to provide it.

Unless a contract says otherwise in writing, we do not use a customer’s content to train public or third-party models. Use of AI systems is not a substitute for professional, legal, medical, or financial judgment.

You agree to use the site and services lawfully and not to:

• Violate the law, third-party rights, or these terms.
• Upload or request unlawful or misleading content, or content that infringes intellectual property or other people’s personal data.
• Attempt unauthorized access, or disrupt or overload our systems or those of our vendors.
• Use the services for spam, fraud, unauthorized surveillance, or to bypass security measures.

The site, the UpskyAI brand, software, text, and other materials we publish belong to UpskyAI or its licensors. You may review them to learn about us or evaluate our services; you may not copy, modify, or otherwise exploit them without permission.

You keep the rights to content you send us. You grant us a limited license to use it only as needed to respond to you, provide the service, and comply with the law. Work delivered in a project is governed by the corresponding contract.

The site is provided “as is” and “as available.” We do not warrant that it will be uninterrupted, error-free, or fit for a particular purpose.

Descriptions of products, research, or future capabilities are informational. They are not a binding offer or a guarantee of results unless a contract says so.

To the extent permitted by Mexican law, UpskyAI will not be liable for indirect or consequential damages, lost profits, or data loss arising from use of the site or information published on it.

Liability for contracted services is governed by the specific agreement. Nothing in these terms limits liability that the law does not allow us to exclude.

The processing of personal data is described in our privacy notice. By using the site, you also acknowledge that notice.

These terms are governed by the laws of the United Mexican States. Any dispute will be submitted to the competent courts of Mexico, without affecting rights you may have as a consumer or personal-data subject.

We may update these terms by posting a new version on this page, with the date of the last update. Continued use of the site after a change means you accept the current version. If a change affects a contracted service, we will notify you by the agreed means when required.
